Hi All,
My previous I-140 was denied due to the ability to pay issue since company was in loss and Idid not get prevailing wage since PD.I have appealed it hoping I can extend my h1 beyond 6th year.Is it true?
Also, Now we have pre approved labor with lower in same company where I can satisfy by showing W-2 to prove the ability to pay. Now If I am planning to apply another I-140 with labor sub,
would it matter to the new I-140 appllication if the previous I-140 was denied and is being currently appealed? Because in the I-140 form there is a question ,
"Has any Immigrant visa petition been filed by or on this person?"
Should I say "YES", Right? and also give the detail of previous filing????
Also How does USCIS verify the W2?BY contacting the IRS or ?
Please suggest?

You have to give them detailed information.if you don't still they pull up your records.
IRS database can be accessed by USCIS under homeland security rule to verify any information regarding an individual.

I agree the right way for Company B was to apply for concurrent H1-B that will allow you to work part time for Company B while working full time with Company A.
Please verify that this is indeed the case with Company B's petition.

Thanks... I have the information..but is not completed....I mean they show us a simple and a basic information but not the specific details..so I just have to wait again for the lettler..the lettler was Sep. 13, 2006. and expired Dec. 6, 2006. I was trying to find the receipt of the 1-140 cause I submit in May 25, 2006 so when called I spoke by the phone with USCIS I was frozen when they told me about the lettler of Sep. 13,(they send us) cause I didn't know... well I have to wait... USCIS have right now this report because the employer never receipt this lettler (none)... the thing is, if they want to approve this application I-140 we hope they will, cause I send again all the documents as the beggining I-140 ETA 750 & attachments, lettler of the employer and the last four taxes of the company..I will see the results... I have faith, and I believe they will fixed..thanks for your support..

I had EAD from Aug 2007 to July 2008 which i never used. Now i would like to get EAD again. Should i file it as renewal or applying for a new one? TIA

Since your attorney is not filing (No G28 is filed when you DIY). I did this and I got approval for both EAD/AP in a month's time.

I am planning to come in Feb,2011.Will I face any issues regarding my visa at the port of entry, because it expires in 8 months. So I am worried regarding that please clarify my query?

I like #2, nicer colors and looks more natural to me.

I tried the suggestion solution: convert all the extensions to xps, then use DocumentViewer to display the file. It's quite neat. Short and simple code!

But, if you had an opportunity, who would you choose and why?

I’m confused about using the EAD. Someone please clarify me….
I already received the EAD for me and my wife. Currently, I’m in the H1b which is expiring on Sep 2008 (6 years are over). My questions are?
•Can I be in H1b and still work another job as a part-time?
------ if the part time job is using a part time H1 only then you will be H1 and dependents in H4 using EAD meaning you lose H1/4
•If my wife wants to work using her EAD does it have any effect on her h4 status?
--- her status becomes AOS pending and H4 is gone
•If my wife loose her job during the use of her EAD what will be her status?
--- she will reamain AOS pending same as while using EAD
•I applied my I485 in July 2, 2007. As I already received my EAD, can I be unemployed after 180 days and start a business by myself?
---- you can be self-employed and have similar job description and LC
•I know after receiving the AP I visit any their country. What will be my status after I come back? Still H1b or anything else?

I am waiting for my EAD receipt and also my I-140 is not cleared yet.
I have to travel india immediately on an emergency and my attorney says that I can very much travel to India on my H1-B visa.
I was quiet surprised to hear that from my attorney as I was under the impression that it is not safe to travel outside US until my EAD is approved.
Please suggest..

I am planning to apply for h1b transfer in the near future but with a paystub that is having salary lesser than the usual one. Is that advisable to do premium processing in this case?
I am looking for the premium processing option as I might have to travel outside USA before I could know about the result(approval or rejection) so I assumed that I can know the result through premium processing, travel without any problem and can get it stamped too.
Or is it fine to travel when I have applied for the transfer?I have my company A visa(which I got last year) stamped in my passport.
please let me know your thoughts

I have received the following 485 Rfe for my spouse and myself, I am posting the whole
text from RFE letter. Also USCIS has sent me a copy of the current I-693 Form which
was sent with our application as a sealed copy.
The reason I think for the RFE is because the civil surgeon I had used was in the list
of USCIS civil surgeons in 2007 but now he is no more in the list, hence as they touched my application now, the form need to be signed by a designed civil surgeon on the current uscis list. Has any one received an rfe like or similar to this.
Please suggest the best possible to resolve this one.

This office is unable to complete the processing of your application without further information. Please read and comply with the request below, then submit the evidence to the above address. Include a copy of this letter and place the attached gold sheet on top of your documents.
A review of your file indicates that the medical examination(Form I-693) you submitted was not completed by a designated civil surgeon, and therefore this Service cannot accept it.
Please take the enclosed copy of Form(I-693) with this notice to the same clinic so that
the designated civil surgeon can review and sign the medical examination. A list of designated civil surgeons can be obtained by calling the USCIS National Customer Service Centre at 1-800-375-8253, or via the USCIS website at www.uscis.gov.
