I (and my spouse as dependent) applied for I-485, AP, and EAD on July 17, 07 and am yet to get the receipt notice. My (and my spouse's) H-1 expires on 12/31/07 and I plan to travel out of the US between November 8 and December 24.
In case, the I-485 receipt notice does not come before we leave, would we be considered as having abandoned the PR application? Any idea how long it might take for the receipt notice to come for people in my shoes?
I'm positive, you can very much travel!!

I just got an update on my and my wife I-485; i dont know what it is but they have requested for more information.
Can any one clarrify that who will get the RFE? will it be me or my lawyer?
If possible can any tell what it would be?

from other posts, I have seen 10 working days wait times.
Pl. keep your post updated for the benefit of others.
Also contact your attoneys and ask them to find ways to check if your petition is present in PIMS. My attorney says there is no way he can. I also called DOS & KCC, they are not helping either.

You need your employer's approval, without them you cannot change the attorney. If employer's says yes, then you can switch attorney.

#2 is my favorite. I find myself pondering where the steps might lead. You composed them very well into the scene. And I really like the moss both on the ground and on the lantern ... unlike today's society, it seems to say "hey, I'm in no rush!" The image has a very peaceful feeling about it that I like a lot.

Here's my situation in briefest form. I'm engaged to a woman in the Philippines. She worked as a domestic helper in Kuwait from about 2005 to 2007, a period of about 2.5 years total.
I understand that as we move forward on our K1 application (I'm an American just be clear) she'll be required to submit police reports for anyplace she has lived for more than 6 months. She doesn't have such an item from Kuwait, and it seems nearly impossible to obtain such a report. The websites all say that this document is only given to 'current residents'.
How can we obtain such document, and what if we can't? It seems unfathomable that the US Gov would request a possibly unobtainable document and then permanently deny our chance to live in the US together, if we are absolutely unable to obtain this document?
Does anyone have any advice, or can tell me what happens in a situation such as this?

I think: We donot have a choice. We have to show up on the day and time given on FP notice. If we can't- we have to request uscis for re-scheduling.
Call the ASC office and usually in such circumstances.. they allow to come earlier... Lots of ASCs are open sat.. So that may be good for you... Call your local ASC...

I got my I-140 (EB3) approved with the priority date of November-2004.
I applied another Labor (EB2) in Feb 2007. When applygin for I-140 for this labor, my lawyer forgot to use the approved I-140 for getting the old priority date (Nov 2004 priority). So, I got the I-140 approval for EB2 case with Feb 2007 Priority date.
Now, can the lawyer change the priority date on the I-140 (EB2) to Nov 2004 using the previous I-140.

I qualified by point system without employment offer. You can take the test on line for free to see if you qualify by the point system.

I am trying to see if I can figure out any trends in how they are selecting cases for 2 yr renewals.
Please post your EB category, PD(month/yr is adequate), and approved EAD length. If we get sufficient responses perhaps we can see any trends.

Would this apply even if one did not file I485 or is I485 required to be filed for H1B extention? Also what if, say, company A files bankrupcy or H1B holder from the company is laid off after I140 is approved AND I485 not applied.

The important thig is the period since yoour last admission to the US before July 2007.
Say you entered in Apr 2007 then you would not have accumulated 180 days of unauthourized stay in US before filling 485 and you will be OK.

I am a little confused. I just got my H1B extension done recently and my attorney sent me a letter saying that if I go out of the country for stamping I need to make sure my Passport is valid beyond the H1B period.
My passport expires in May 2008 and my current H1 is valid till July 2010. Does anyone see any issues in going for stamping in India in July 2007 with my current passport and later on some time next year applying for a new Indian passport.
Appreciate your help
Your passport should be valid atleast 6 months from the date of stamping. So I think you should be okay. Also, its better to apply for a new passport 6 months before your old one expires. And once you get your new passport you'll have to carry both your new and the old ones as your old one will have the stamping till July 2010. Hope this helps!

It might be helpful to gather numbers on how many of the July/Aug filers have invoked AC21 (with or without letting USCIS know)
